The effects of climate change and toxins in our environment come under daily scrutiny. Federal, Provincial and Municipal governments all have a part to play in the protection of the environment through Acts, Regulations and by-laws. Adherence to these standards can become very costly to a business owner after there has been a spill or release of a pollutant.
Pollution Liability is not intended to respond to damages or costs which are expected or intended from the standpoint of any insured. It is to be sudden and accidental and caused only by a pollution incident. It also excludes liability which may be assumed under contract. The insurance applies to pollution incidents which occur in the Province of Ontario and the exclusions clearly restrict any claims that may arise from outside Canada.
